The Terms, as detailed below, apply to www.vishwaroopam.org platforms and other VISHWAROOPAM-related sites, apps, communications, and other services that state that they are offered under the set of these Terms, including offsite data collection for those Services/functions, and with VISHWAROOPAM plugins (if any).

We, VISHWAROOPAM-THE COLLABORATORY, which includes its COLLABORATIVE  SCHOOLS FOR  ECO HEALTH, ECO DESIGN, ECO MEDIA  ARTS & MEDIA and BE LABS FOR ENGAGED LEARNING & RESEARCH, and  its Chief Promoter  the VISHWAROOPAM ADVISORY & ENABLEMENT LABS, constitute  an educational, non-profit platform for social development in character. We do everything we can to ensure that your experience with us is enjoyable and easy. Through innovative and collaborative initiatives, we investigate the creative, cultural, educational, and social power of both experts and amateurs. This platform is owned and operated by website www.vishwaroopam.org, called hereinafter ‘VISHWAROOPAM', at present hosted with web domain www.vishwaroopam.org.   In this Privacy Policy, “we”, “us” and “our” refer to VISHWAROOPAM.

These terms and conditions explain our interactions with you as follows:

1. VISHWAROOPAM serves with a mission to take the message of eco design,  eco-art, media  and culture to the avid learners, creatives, educators, and media amateurs, and communities at large who are the preservers of ecosystems or environment. With its field projects, diverse audiences, and user-bases in mind, it strives to be an accessible and responsible digital platform, as exemplified by its many sections, pages, and interactive features. We are  dedicated with unstinted focus to facilitate people to explore nature and cultivate their hidden potential, channelize their thoughts and actions towards enhancing their role with the help of every day ecology and eco media in all respective spheres.  Our services are designed to promote and provide  opportunity for our partners, collaborators, or visitors  by enabling users to meet, exchange ideas, learn, and find opportunities in a network of trusted relationships through a variety of educational programmes and outreach of VISHWAROOPAM.

2. VISHWAROOPAM contributors or users represent and warrant that they have all the rights necessary to grant non-exclusive license for the content or own all of the contributed content, feedback, and personal information they offer to us, and  they also grant a non-exclusive license to VISHWAROOPAM owner(s), which includes displaying or publishing to the public at large, globally. They own the submitted content and information, which is protected by their respective applicable intellectual property rights, or if they  have the right to share someone else's creative output if it is made available to them as part of the relevant authorization or whose exclusive copyrights they  hold and there is no third-party infringement of any intellectual property rights by the content.

3. VISHWAROOPAM contributors  expressly  grant the worldwide, permanent, irrevocable, transferable, perpetual, and sub-licensable non-exclusive, royalty-free license and copyrights to VISHWAROOPAM and its website(s) or social media applications to publish, post, reformat,  copy, edit, modify including translation, adapt, reproduce, index/list information regarding, store, archive, make available, link to, distribute, syndicate, broadcast, webcast, make available,  publicly perform or display, process, make derivative works of all such Content and my name, voice, and/or likeness as contained in  the content, in whole or in part, and otherwise use, information and content (in part or whole) provided by them  on or through  use in connection with the  VISHWAROOPAM platforms, services, emails, VISHWAROOPAM hosts, or links without further consent, notice, or compensation and otherwise exploit the content and media in any and all forms and media or technology (now known or hereafter developed) which includes, but is not limited to, promoting and redistributing a portion or the entirety of the Service (including derivative works thereof) in any media format and through any media channels. VISHWAROOPAM may, but is under no obligation, to identify us as the owner of such content in their promotions  or other communications. If their intellectual property rights prevents  use of the said content, VISHWAROOPAM will need their express permission. They agree to abide by the Creative Commons Zero (CC0) license  for the content contributed by them to VISHWAROOPAM website/platforms so that it shall be treated by VISHWAROOPAM as "CC0 Content". Therefore, authors of the work which is contributed by them to VISHWAROOPAM accept that they have waived all of their rights to the CC0 Content provided by them for  the world wide usage under copyright law, including any related and neighbouring rights, to the fullest extent permissible by applicable law. They accept that the content provided by them  will be made available to the public on and through the service for use of third parties  under a  freely revocable Creative Commons Zero (CC0) license or in certain specific request cases under  Creative Commons Attribution-Non Commercial-Share Alike 4.0 International (CC BY-NC-SA 4.0) arrangement which prohibits the use of the  content for commercial purposes. They also accept that the content provided by them will be used by VISHWAROOPAM abiding by  their  General Terms and Privacy and Policy Statements, and  made available  to the public or for download  by VISHWAROOPAM  for free and  non-  commercial purposes of third parties use  subject to limitations placed by these Terms or the conditions laid down by law without seeking any attribution or compensation.

 

4. Except for the  generative content, the  content contributed to VISHWAROOPAM in accordance with these terms, the services and all materials therein or transferred thereby, including, without limitation, software, text, graphics, imagery, logos, service marks, patents, copyrights, photos, audio, videos, and music, and user content posted to or belonging to VISHWAROOPAM, other users, and other licensors,  to VISHWAROOPAM (the "VISHWAROOPAM Content"), and all Intellectual Property Rights related thereto, are owned by VISHWAROOPAM and  other rightful users. Users agree not to sell, license, rent, reverse engineer, decompile, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any VISHWAROOPAM Content unless expressly permitted by these Terms. They also agree not to modify, adapt, edit, or create derivative works from any VISHWAROOPAM Content. It is completely forbidden to use the VISHWAROOPAM Content for any purposes not specifically allowed by these Terms.

5. VISHWAROOPAM can remove any content from its use at any time if  it’s flawed, has unsatisfactory quality for the purpose or relevance or contravenes the Terms applicable from time to time. Content can also be removed if VISHWAROOPAM learns of any violations of the law through content itself, or  links to third-party websites, or any unprofessional/unlawful/commercial promotions brought/published on this website.                                                                         

6. Copyright transfer enables VISHWAROOPAM or its affiliates to host, reproduce, distribute, communicate, and use contributed content. This includes saving it on computer systems or IT applications or media,  publishing, performing, or displaying it. Rights can also be sublicensed to other users for limited purposes, allowing contributors to share photos with others to allow VISHWAROOPAM services as intended.

7. This copyright transfer is for the exclusive purpose of operating and improving the VISHWAROOPAM platforms, services, or functions, which includes allowing them to perform as intended and developing new features and functionalities. This includes identifying patterns in data, using algorithms and automated systems, or conducting analysis as content is being transmitted, received, or stored.

 

8. The VISHWAROOPAM rights over the contributed content last for as long as such content is protected by intellectual property rights. Educational institutions and non-profit organizations are welcome to use VISHWAROOPAM services, but they must do so through an authorized representative of the organization and accept these terms and the privacy statement.

 

9. As a non-profit organization, VISHWAROOPAM adheres to its policy of not including donated or self-generated content in advertising for third-party products and services, including sponsored content. If such an incident occurs at the request of content copyright holders or without their knowledge, VISHWAROOPAM accepts no responsibility for any violation of its Terms or Privacy Policy.

10. All of the information on the website is not solely owned by VISHWAROOPAM as some of it might be protected by intellectual property or image rights that belong to third parties and not us. VISHWAROOPAM also publishes some of its online content under a Creative Commons Attribution-Non Commercial-Share Alike 4.0 International (CC BY-NC-SA 4.0) arrangement. This prohibits the use of our content for commercial purposes. and unless otherwise specified, the bulk of photographs on the VISHWAROOPAM website are owned by it (except copyright free images from WIX platform or other public domain images websites/platforms) , so their re-use may be subject to restrictions.

11. Similarly, not all content on the VISHWAROOPAM website is covered by the Creative Commons license. Additionally, certain work may not be shareable even under a Creative Commons license because of cultural sensitivities or because it would violate VISHWAROOPAM's code of ethics.

12. VISHWAROOPAM content on social media sites can be used as long as it's not commercially linked or advertises. Some sites may have a Creative Commons Attribution/ ShareAlike license, allowing commercial use. However, uploading content to these sites grants site hosts permission for commercial use and does not qualify for  VISHWAROOPAM permissions.

13. VISHWAROOPAM users/contributors/collaborators/partners/hosts may note specifically   -

• That VISHWAROOPAM retains sole ownership of all intellectual property rights on the platforms/services to its own content or displays. It does not permit the removal, concealing, or modification of any of its branding or professional aspects without its express permission.

• VISHWAROOPAM may access, retain, process, and use any information and personal data given in accordance with these terms and the Privacy Policy, as well as their preferences which include settings.

• That they own their own content and information, and VISHWAROOPAM has only non-exclusive, royalty-free rights to it, which they may choose to share with others.

• That if their content contains personal information, it is subject to the VISHWAROOPAM Privacy Policy.

• That the submission of ideas or other feedback authorizes VISHWAROOPAM to use and disseminate such ideas for educational or social awareness purposes for the benefit of the public good, albeit it's not required to do so. The submitters or their assignees won't receive any monetary or in-kind compensation.

• VISHWAROOPAM may update and format their content, such as by translating or transcribing it, changing the size, layout, or file type, or eliminating meta-data/superfluous data.

• That they will only contribute information and content that they have a legal right to share or that does not infringe the law or the rights of others, including intellectual property rights, copyrights, data rights, neighbouring rights, name or personality rights, or other property rights and that their User/profile Information will be accurate.

• That if they utilize any VISHWAROOPAM Service feature, VISHWAROOPAM may mention it, with or without their name or photo, to promote that feature within its services/functionalities in order to achieve its stated purposes.

• In some countries, VISHWAROOPAM may be required by law to remove particular information or content.

• VISHWAROOPAM reserves the right to alter, suspend or stop any of its services, either permanently or temporarily or prospectively.

• VISHWAROOPAM makes no promises to store or continue to display any information or content that has been shared with it.

• That their use of others' content and information posted on our services is at their own risk; however, subject to these Terms and Privacy Policy, others may offer their own philanthropic educational services on a purely non-commercial basis through VISHWAROOPAM Services without VISHWAROOPAM's knowledge, and in such cases, VISHWAROOPAM is neither responsible for nor a beneficiary of those third-party activities.

• They understand that because VISHWAROOPAM is unable to check content for these problems, they may come across content or information that is erroneous, lacking, or delayed. As a result, VISHWAROOPAM platforms are not liable for the content or information of others, who are their sole owners.

• They give us the authorization to enforce any violations of the sublicenses we give other parties for the content under their copyrights. They agree to assist us in asserting the obtained rights in court or out of court, particularly by providing information, providing the required original documents and other documents, making or having made the necessary assignment of rights to VISHWAROOPAM, and making or having made any additional declarations or documents that may be necessary or helpful for the realization of the license they have granted to us

• While VISHWAROOPAM may also provide access to third-party content, such content cannot be used without the consent of the owner of the third-party content or as otherwise permitted by law.

• The views represented in other people's or organizations' content are theirs, and do not necessarily reflect the views of VISHWAROOPAM or its partners, collaborators, co-creators, affiliates, or promoters.

• VISHWAROOPAM does not supervise, direct, manage, or monitor them in the performance of these services, and is not liable for the offering, performance, or procurement of these services to any third party for any consideration other than its aims as stated in the Privacy Policy and these Terms.

• VISHWAROOPAM does not endorse their contributions, and nothing in utilizing their contributions or services shall create an employment, agency, or joint venture relationship with them.

• VISHWAROOPAM is not liable for the actions of any of them or other  attendees at its events.

• VISHWAROOPAM does not advocate, review, or vet any event published on its platforms by its Members.

• VISHWAROOPAM reserves the right, in the interest of public welfare, to restrict, suspend, or terminate their use of the platforms or their capacity to contact others, including how they connect and engage on the platforms or services.

• The trademarks and logos used in connection with the Services are the property of their respective owners, who have consented to these Terms and the Privacy Policy. In contrast, all media presented or displayed on VISHWAROOPAM platform shall be the  unaltered intellectual property rights of the relevant VISHWAROOPAM contributors, professionals, and artists, subject to these Terms and the Privacy Policy.

• A content shared under the Creative Commons Zero ("CC0") has no effect on any person's patent or trademark rights, nor on any other person's rights in CC0 Content or on how the CC0 Content is utilized, such as publicity or privacy rights. As a result, depending on the intended use of the CC0 Content, the representation of identifiable people, logos, trademarks, or copyrightable work in the CC0 Content may still require permission or authorization from third parties.  Furthermore, there is no implied endorsement for any product or service by the creator of the CC0-Content and/or any person, entity, or brand shown in the CC0-Content while any one is using the CC0-Content.

• While VISHWAROOPAM respects others intellectual property rights, it also demands that the information provided to it  be correct and not infringe upon anybody else's rights. These terms and the Privacy Policy,  do not benefit any third parties.

14. Memberships as  Bright Ecology Fellows or Associates or Collaboratory Partners, or in any other role, help us to carry out our educational social change  objectives supporting eco creatives and promoting their excellence.  The specifics of the submissions and declarations are given in concerned registration forms from time to time  which might be made available  in response to those  expressing their interest. Please  submit only if you consciously agree with the same. You may cancel you Membership/Associateship  at any time by an e-mail request at brightecologyworld@gmail.com.

15. During all events, workshops, and programs, please turn off your cell phone. We are in favour of free speech and discussion. We anticipate that instructors, panelists, presenters, and attendees will treat one another with dignity and offer helpful, constructive feedback.  Additionally, the venue management retains the right to make any reasonable request for guests to leave the venue at any time, and they may take any necessary legal action to uphold this right.  At events,  VISHWAROOPAM routinely records audio, video, and pictures. These might be posted on social media and utilized for advertising. In the case that you would prefer not to have your participation in any program or event recorded in this way, kindly inform us as soon as possible.

16. Modifications to the programmes -The mentors and programs that are promoted may change at any time, with notice from VISHWAROOPAM.

17. Despite VISHWAROOPAM's best efforts to uphold high standards and give all Creatives and Visitors excellent experiences, you might wish to voice your opinions or send a protest. Recall that written complaints must be submitted in every case.

 

18. Disclaimer of legal liability for the quality, safety, or reliability of VISHWAROOPAM services:

a) The materials on the website have been carefully and meticulously prepared, but we hereby disclaim all claims, express or implied, as to their accuracy. The materials are always works in progress, and we reserve the right to make changes without prior notice. If people  utilize or rely on the Materials, we are not responsible for any loss or damage that results.)

b) This  website may include links to other websites. They are simply offered for user convenience. As VISHWAROOPAM has no control or influence  on the content linked to external sites it is not responsible for the same which is governed by the concerned third party terms and conditions you might visit through the links. Any information or claims on those websites or websites referenced to or linked to those websites, are not sponsored by us, and we do not necessarily confirm their accuracy/completeness  nor endorse nor otherwise agree with them.)

c) The services are provided on a "as is" and "as available" basis by VISHWAROOPAM, its affiliates, or its promoter(s), and no representation or warranty is made regarding the services, including any warranty that the services will be uninterrupted, timely, secure  or error-free. VISHWAROOPAM and its affiliates disclaim any implied or statutory warranty, including that of title, accuracy of data, non-infringement, commercializability, or suitability for a specific purpose, to the fullest extent permissible by relevant law.

d) To the maximum extent permitted by law, VISHWAROOPAM, including its affiliates, collaborators, or promoter(s), will not be liable in connection with these terms for lost profits or lost business opportunities, reputation, loss of data (such as downtime or loss), use of, or modifications to, information or content of others, unless VISHWAROOPAM and its affiliates or promoter(s) have entered into a separate written agreement that supersedes these terms. Except as required by law, neither VISHWAROOPAM nor any of its affiliates or promoters shall be liable for any sum nor for any special, incidental, consequential, punitive, or exemplary damages or lost expenses resulting from use of resources in conjunction with the services offered herein, except as required by law.

e) Inaccuracies, omissions, interruptions, deletions, flaws, delays in operation or transmission, communication channel failures, or improper  access, theft, damage, or tampering of user communications are all exempt from liability for VISHWAROOPAM. In addition,  unless these are under VISHWAROOPAM's control, VISHWAROOPAM is not responsible for issues such as technical malfunctions related to telecom networks or paths, online platforms, servers or service providers, computer hardware, software, or errors of correspondence or players as a result of issues or data clogs on the internet and/or digital solutions.

f) These exclusions from liability do not apply to liability for death or personal injury, fraud, wilful misconduct, or gross negligence, or in cases of negligence where a material obligation has been broken. A material obligation is one that is necessary for the provision of VISHWAROOPAM services and on which individuals may reasonably rely. However, this exclusion only applies to the extent that the damages were directly brought on by the breach and were foreseeably associated with the enforcement of these Terms.

g) Except for the survival of some legitimate rights and obligations, such as the rights to use and disclose feedback or the rights of copyright holders to further re-share content and information submitted through VISHWAROOPAM, the Terms and Privacy Policy cease to be applicable in the event that they are terminated.

 

19. Arbitration:

In the event of a dispute relating to these terms, their enforceability, and/or change, VISHWAROOPAM shall appoint an arbitrator. The arbitration will take place in Delhi, India, and will be conducted in English.  The arbitrator's decision will be final and enforceable against both parties. This arbitration will be conducted in accordance with the Arbitration and Conciliation Act of 1996, as revised to the present. While adjudicating on any dispute, enforceability, or amendment of these Terms, courts in New Delhi shall have exclusive authority under Indian Laws.  If VISHWAROOPAM, its affiliates, or its promoter(s) do not take action to enforce a violation of these Terms or the Privacy Policy, it is not proof that they have relinquished their rights to do so.

 

20. Modifications to Terms:

At the time of publishing, all of the information on the website and in printed materials is accurate. VISHWAROOPAM retains the right, at any time, to alter or amend these Terms, including for purposes of law, regulation, or security.  You are responsible for regularly checking the Terms for updates, even though we will notify you of significant changes by contact or by flagging them on the Website.
